1. Professional Licensing and Corporate Identity

These Investment Terms and Disclosures govern all real estate brokerage operations, deal sheets, property searches, and analytical services facilitated by Global Properties SPC (Single Person Company), Muscat, Sultanate of Oman. The Company operates as a fully licensed and compliant real estate agency under Omani commercial and housing laws.

Our advisory, search, and intermediary operations strictly adhere to the provisions of Royal Decree No. 2/98 regulating real estate brokerage activities in the Sultanate of Oman. We act in coordination with the Ministry of Housing and Urban Planning (MHUP) to protect investor contracts and escrow accounts.

2. Foreign Ownership Legislation (ITCs)

Non-Omani individuals, families, and foreign corporations are legally entitled to purchase freehold real estate with 100% full absolute ownership (freehold status) within designated developments known as **Integrated Tourism Complexes (ITCs)**.

This statutory right is established under **Royal Decree No. 12/2006** (the Law Regulating Real Estate in Integrated Tourism Complexes). Foreign buyers are granted absolute title deeds (Mulkiya) for their land and units, with unlimited rights to sell, lease, or pass the property to heirs.

Important Notice: While foreign ownership in ITCs (such as Al Mouj Muscat, Jebel Sifah, and Hawana Salalah) is fully permitted, direct land and property purchases by non-Omanis in specific border regions, strategic lands, agricultural zones, and non-ITC historical quarters are restricted in compliance with Royal Decree No. 42/2021.

3. Omani Investment Residency Program (IRP)

Purchasing premium real estate in designated developments provides a direct pathway for foreign buyers, their spouses, and dependents to obtain long-term Omani residency. This is governed by the Oman Investment Residency Program (IRP) and directives issued by the Ministry of Commerce, Industry and Investment Promotion (MOCIIP):

  • First-Class 10-Year Residency: Foreign investors are entitled to a renewable 10-year residency visa upon purchasing real estate or multiple ITC properties with a combined value of at least OMR 500,000.
  • Second-Class 5-Year Residency: Foreign investors are entitled to a renewable 5-year residency visa upon purchasing ITC property with an investment value of at least OMR 250,000.

Residency permits are issued directly in collaboration with the MOCIIP, the Ministry of Housing and Urban Planning, and the Royal Oman Police (ROP), subject to medical, KYC, and security clearances.

4. Developer Escrow Safety Mandate

For all premium off-plan (under construction) residential acquisitions, investor payments must be deposited directly into an official project-specific **Escrow Account** registered and approved by the Ministry of Housing and Urban Planning.

This mandate is enforced under **Ministerial Decision No. 72/2014** (Escrow Accounts Regulations for Real Estate Development Projects). Omani developers are prohibited from using buyer funds for general company operations; funds are disbursed strictly linked to verified construction milestones, protecting buyers against project delays or defaults.

5. Government Levies, Registration and Tax Exemptions

The Sultanate of Oman offers a highly attractive, tax-friendly environment for property buyers. The following financial parameters apply:

  • Ministry Registration Fee: A flat registration transfer tax of 3% to 5% (standard housing ministry registration is currently 3% to 5% of the property value, with 5% as the standard OMR housing tax) is payable by the buyer to the Ministry of Housing and Urban Planning to issue the absolute title deed (Mulkiya).
  • 0% Income Tax: The Sultanate of Oman levies zero personal income tax on net rental cashflows earned by individual real estate owners.
  • 0% Capital Gains Tax: No capital gains taxes are charged upon reselling real property in Oman.
  • 0% Inheritance Tax: Property inheritance transfers to legitimate heirs are free from death taxes or inheritance levies.

6. Investment Risk Disclaimer
